Healing Heroes Terms and Conditions
These terms and conditions (“Agreement”) set forth the general terms and conditions of your use of the Miracles Ultimate Wellness Resources website (“miraclesdirectory.com/”, “Website” or “Service”) and any of its related products and services (collectively, “Services”).
This Agreement is legally binding between you (“Practitioner”, “Healing Hero” “you” or “your”) and this Website operator (“Operator”, “we”, “us” or “our”). If you are entering into this agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this agreement, in which case the terms “User”, “you” or “your” shall refer to such entity.
If you do not have such authority, or if you do not agree with the terms of this agreement, you must not accept this agreement and may not access and use the Website and Services. By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. You acknowledge that this Agreement is a contract between you and the Operator, even though it is electronic and is not physically signed by you, and it governs your use of the Website and Services.
Description of Services
We host third-party practitioners of the healing arts (“Practitioners” or “Healing Heroes”) who utilize the Website to advertise, market, and sell products and services (“Practitioner Services”) to third-party users (“Users”) of the Website.
Membership Requirements & Obligations
You must be at least eighteen (18) years of age to use the Website and Services. By using the Website and Services and by agreeing to this Agreement, you warrant and represent that you are at least 18 years of age.
“Membership” refers to participation in one of three membership packages we offer: Basic, Enhanced, and Premium. As a Practitioner, you are encouraged (but not obligated) to advertise, market, and sell your service or product on the Website.
Billing & Payments
We charge one monthly fee for access to one of the three Membership Services (Basic, Enhanced, and Premium). In addition to hosting Practitioner Memberships, we offer other Practitioner Services and subscription packages for additional fees. We reserve the right to change our fees and prices with thirty (30) days’ advance notice posted on our price listing page(s) and/or sent by email. Should you continue the service, the new price will be applied at the start of the next billing cycle.
Accuracy of Information
We may occasionally publish information with typographical errors, inaccuracies, or omissions (including product descriptions, pricing, and promotions). We reserve the right to correct such errors without prior notice. Practitioners should report any inaccuracies to Customer Service at Support@MiraclesDirectory.com. Updates will be made as soon as possible. We make no guarantee that the Website will be error-free, but we will strive to correct issues promptly. We are under no obligation to update Website information unless specifically requested by you or another Practitioner.
Practitioner Services & Responsibilities
We do not assume responsibility for:
- The services or products you sell on or off the Website;
- Fees charged to your clients or customers;
- Any third-party distribution method for your service/product; and
- Any disputes between you and your clients/customers.
You retain all profits from your sales and assume all business risks, costs, and liabilities. We expect you to operate lawfully and in good faith with Users.
We do not endorse, are not responsible for, and make no representations about your services, including how you handle data or interact with Users. You waive any claim against the Operator regarding your service performance.
Backups
We perform regular backups of the Website and its content and will restore them in case of hardware failure or data loss to minimize downtime.
Links to Other Resources
We may link to other websites or resources. This does not imply approval, endorsement, or affiliation unless stated. We are not responsible for the offerings, content, or conduct of linked resources. Use of such resources is at the User’s own risk.
Prohibited Uses
You may not use the Website or Services to: (a) engage in unlawful activity; (b) solicit unlawful acts; (c) violate regulations or laws; (d) infringe intellectual property rights that belong to Miracles Directory, Miracles Ultimate Wellness Resources, Miracles Ultimate Business Academy, Miracles Healing Arts Academy (aka known as the “Academies”), and other proprietors who expressly own their specific individual course content, all of which courses in totality are the intellectual property of the Academies offered on the Miracles Ultimate Wellness Resources platform; (e) harass, abuse, harm, defame, discriminate, or intimidate; (f) submit false/misleading information; (g) upload or transmit malicious code; (h) spam, phish, pharm, pretext, spider, crawl, or scrape; (i) engage in obscene or immoral conduct; or (j) interfere with or bypass security features. Violation of prohibited uses may result in termination of access and, additionally, legal action.
Limitation of Liability
The Service is provided “as is” and “as available.” Use of the Website is at your own risk. We expressly disclaim all warranties, express or implied, including but not limited to increased clients, expanded business models, increased income, increased social media and other marketing viewership. The success of your business is based on your personal efforts in your business. Miracles Ultimate Wellness Resources provides tools, techniques, information, and exposure opportunities to support your health and wellness business.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential damages. Our maximum liability will not exceed one dollar ($1) or the amount paid by you to the Operator for the prior one-month period, whichever is greater.
Indemnification
You agree to indemnify and hold harmless the Operator and affiliates from claims, damages, or costs (including attorney’s fees) arising from your use of the Website, Services, or any misconduct.
Severability
If any provision of this Agreement is found invalid or unenforceable, the remaining provisions will remain in full effect.
Dispute Resolution & Governing Law
This Agreement is governed by the laws of California, United States, without regard to conflicts of law rules. Exclusive jurisdiction lies with the courts located in California, United States.
You waive any right to a jury trial. The UN Convention on Contracts for the International Sale of Goods does not apply.
Changes & Amendments
We reserve the right to modify this Agreement at any time. Changes will take effect immediately upon posting unless otherwise stated. Continued use of the Website constitutes acceptance of revised terms.
Return Policy
Due to the nature of our services and instant access to content, we have a strict no-refunds policy. For concerns, contact our support team.
Termination
You may terminate your use of the Services at any time, but no refunds or pro-rata credits will be issued for unused time within the current billing cycle.
